Terms of Service

These Terms of Service ("Terms") govern access to and use of Noxify's website, AI-powered voice receptionist, appointment scheduling, automation, and related services. By using Noxify, you agree to these Terms.

1. Services

Noxify provides business automation services that may include AI voice reception, call handling, appointment scheduling, CRM workflows, calendar and spreadsheet integrations, and other configured automations. Specific features depend on the customer's service configuration and plan.

2. Customer responsibilities

• Provide accurate business information, policies, schedules, pricing, and instructions.
• Maintain appropriate access rights to accounts and services connected to Noxify.
• Use Noxify in compliance with applicable laws and regulations.
• Provide notices and obtain any consents required for call recording, transcription, automated communications, or handling customer information.
• Maintain appropriate human review and backup procedures for important business operations.

3. Third-party services

Noxify may integrate with third-party platforms such as communications providers, calendar services, automation platforms, cloud providers, and AI technology providers. Your use of those services may also be subject to their own terms and privacy policies. Third-party outages, API changes, revoked permissions, or account restrictions may affect Noxify features that depend on those services.

4. Google integrations

If you connect a Google account, you authorize Noxify to access the Google data required for the features you choose to use, such as checking calendar availability, managing appointments, or writing records to a spreadsheet you designate. You may revoke Google access through your Google Account settings, although doing so may disable related functionality. Our handling of Google user data is described in our Privacy Policy.

5. Acceptable use

You may not use Noxify to violate applicable law or another person's rights, commit fraud or deceptive conduct, attempt unauthorized access to systems or data, distribute malware, interfere with service security, place unsolicited automated calls in violation of telemarketing law, or use integrations in a manner prohibited by the applicable third-party provider.

6. AI and automated outputs

Noxify uses automated and AI-assisted systems. These systems can make mistakes, misunderstand callers, or produce inaccurate outputs. Customers are responsible for determining the appropriate level of human review for their business and for providing accurate configuration information.

7. Service availability

We work to keep the service available, but we do not guarantee uninterrupted or error-free operation unless a specific service level is agreed in writing. We may modify, update, suspend, or discontinue features when reasonably necessary, including in response to third-party platform changes.

8. Fees, billing and included usage

Paid services are subject to the pricing, billing frequency, usage terms, and other commercial terms agreed with the customer. Plans include a stated allowance of talk-minutes per billing period; usage beyond that allowance is billed at the overage rate for the plan. One-time build fees are charged at the start of an engagement. Any separate written customer agreement controls where it conflicts with these Terms.

9. Term, cancellation and the 30-day guarantee

Unless otherwise agreed in writing, subscriptions run month to month and may be cancelled at any time by written notice to info@noxify.co, effective at the end of the then-current billing period.

New customers may request a refund of the one-time build fee and the first month's subscription fee within 30 days of the agent going live, if the agent has not performed its core function of answering calls and creating appointments as configured. The guarantee applies once per customer and does not cover third-party pass-through charges or usage beyond the included allowance.

10. Intellectual property

Noxify and its licensors retain rights in the Noxify service, software, branding, workflows, and related materials. Customers retain their rights in their own business data and content.

11. Privacy and confidentiality

Our handling of personal information is described in our Privacy Policy. Each party should use reasonable care to protect non-public information received from the other party.

12. Disclaimer of warranties

To the maximum extent permitted by law, Noxify is provided on an "as is" and "as available" basis without warranties of uninterrupted operation, perfect accuracy, or fitness for every particular business purpose.

13. Limitation of liability

To the maximum extent permitted by law, Noxify will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business opportunities, or loss of data arising from use of the service. Any different liability terms agreed in a separate written customer agreement will control to the extent of a conflict.

14. Termination

Access may be suspended or terminated when reasonably necessary for security, nonpayment, policy violations, unlawful use, or protection of the service and its users, subject to any applicable written customer agreement.

15. Changes to these Terms

We may update these Terms from time to time. The effective date shown on this page reflects the latest revision.
